Man sentenced for attacking Australian tourist

 A man facing charges for attacking an Australian tourist with a skateboard and then dragging him into a burning fire pit in Ocean Beach received his punishment on Wednesday and is to serve 14 years in prison. 

Damian Maple, 22, admitted to the charges of attempted murder on Feb. 6 in the attack that occurred in February 2008. He also entered a guilty plea to charges of assault in an unrelated incident in which he attacked a man by Dog Beach, also located in Ocean Beach.

San Diego Superior Court Judge David Danielsen ruled that Maple serve this term after Maple placed his plea agreement in the incident. 

Another man was accused of being part of the attack along with Maple in the attack on Robert Schneider, a surfer from Adelaide, Australia. The other man being charged, Francisco Montoya, 48, entered a guilty plea as well but to assault with a deadly weapon and received his sentence in March to serve two years in jail. 

According to authorities, both men are transients.  

A witness at a hearing stated that the men were part of a group that gathered on the beach, some of whom were consuming alcohol. A brawl started a little after 5 a.m. which resulted in the beating and burning of Schneider. 

Witnesses informed officials that Maple pulled Schneider into the “glowing” fire pit and then took a skateboard and used it to shovel hot coals onto his stomach. Schneider, who at the time was 26-years-old, was severely injured in the incident. He received burns, a skull fracture and a broken eye socket, as stated in the testimony. He went home to Australia after he was in the hospital for numerous weeks receiving treatment. 

Deputy District Attorney Patty Herian has reported Maple is also responsible for breaking another man’s jaw in a fight on Feb. 9, 2008 which took place in a parking lot by Dog Beach.
