High school student accused of rape

Posted by Christina on Sep 26 2009 | Rape Report, sexual assault

A 16-year-old San Marcos student accused of assaulting a high schooler this spring and a 13-year-old student from a school in the area last year was taken into custody yesterday morning, sheriff’s deputies reported.

Deputies in the sexual assault department took the boy into custody around 10:30 a.m. and reported that he was sent to stay at the Juvenile Hall under sexual assault charges, including rape by intoxication.

Authorities started to look into the case when a 14-year-old girl called officials on Sept. 6 and reported that she had been a victim of rape by another student at San Marcos High School.

The girl reported to authorities that on May 12, two boys brought her to the back of a business complex by the school and raped her, deputies stated.

Investigators in the sexual assault unit later found out that one of the two boys thought to have attacked the girl was also a suspect in a sexual assault case involving a 13-year-old student at another school in January 2008.

During the time of the student’s assault last year, the student did not want to draw further attention to the case, deputies reported.

Deputies added that they are still looking into the case. They will send the case to the  District Attorney’s Office to look over the terms and charges.

Couple attacked by gang members, man stabbed in their defense

Posted by Christina on Sep 26 2009 | Stabbings

The District Attorney’s Office has come to an agreement to not file charges in a case involving the fatal stabbing of a teen last weekend in National City.

Prosecutors stated that looking over the case this week revealed that Danny Aparicio, 25, was attempting to protect his mother and her boyfriend in the midst of a gang attack, and in his attempt he was stabbed by one of the attackers, Esteban Pabloff, 17.

“Based on the facts, it was apparent that he has a very viable ‘defense of others’ claim,” Deputy District Attorney Gregg McClain stated yesterday.

Investigators have determined that the couple was walking with their dog down Highland Avenue around 2 a.m. Saturday when a group of males approached the boyfriend and began shouting gang phrases. The group then started to attack him and beat him, reported National City police Lt. Craig Boegler.

Aparicio, who was hanging out in an apartment close to the area, was able to hear the couple shout for help and rushed over to assist them.

Pabloff was stabbed in the neck; the others took off running.  Pabloff passed away at UCSD Medical Center.

Following the attack, detectives took Aparicio into custody under suspicion of murder; he has been let go from jail as of recent reports.

The attack involving the couple is being looked into further, Boegler stated.

Rachel Lynn Carlock entered a guilty plea to one count of possession and use of a destructive device in order to carry out a violent crime. According to the nature of her charge, she is to be sentenced to serve at least 30 years in jail. She is to receive her sentencing on March 9.

She said that she was guilty for buying 2 pounds of explosives in April 2008 and then creating a couple bombs, as stated in the plea agreement.

Carlock also said she had put three pipe bombs in front of the courthouse located on Front Street early in the morning on May 4.

No one was hurt when the bombs blew up, which projected nails and shrapnel for a couple blocks. The reasoning behind the bombings are not yet known.

Two others, Ella Louise Sanders and Eric Robinson, had admitted to the crime earlier than Carlock and were also waiting to receive their punishment.

“I was in a desperate situation at the time,” Carlock said to District Judge Margaret McKeown. “Really unhappy. It wasn’t my own will to do it. I was forced to do it. I apologize for doing it.”
