Attorney files appeal to ruling made regarding MiraCosta settlement

Attorney Leon Page filed an appeal against a court decision that resulted in favor of the MiraCosta College board of trustees stating that their actions were right and had good reason in giving former college President Victoria Muñoz Richart $1.6 million to resign.

Page disagreed, stating that the money that was offered Richart qualifies as an illegal payment of money in which public funds were used, and he wants the ruling to be changed. 

Superior Court Judge Thomas Nugent made a decision against Page in his ruling in October.

Page filed a document In December stating that he was going to press for an appeal and turned in his reasonings to the 4th District Court of Appeal yesterday.

The community college district is distributed about the coastline with different campuses planted in Oceanside and Encinitas. The college stretches from Camp Pendleton to Carmel Valley.

Richart was the former president for three years. 

The college officials met overnight in a confidential meeting and decided on her retirement money and settlement agreement in June 2007.
