Posted by Christina on Aug 14 2009 | Premier Attorneys

A man accused of shooting his cousin to death about four years ago while the two were on an eastern San Diego street received 21 years in jail on Wednesday.

Byron Lee Haynes, 31, entered a guilty plea in July admitting to charges of voluntary manslaughter and also charges for use of a firearm during the murder of Michael Haywood, 27. The body was found by people on the road traveling on Jeff Street, authorities reported.

San Diego Superior Court Judge David M. Gill decided on Wednesday that Haynes should serve in jail in accordance to the plea agreement presented.

According to witnesses, Haynes’ was responsible for the death of Haywood. Haynes had already been in County Jail serving other charges not having to do with the shooting of his cousin.

Deputy District Attorney Cari Phillips informed during an interview Wednesday that Haywood, Haynes and another man were on their way to rob a place during the time that the shooting occurred. The robbery was never carried out.

Haywood was fired on twice and passed away in the street.

Investigator to stand trial for tampering with witness in son’s case

Posted by Christina on Apr 14 2009 | Criminal Defense, Premier Attorneys

An investigator, who is a part of the San Diego County Public Defender’s Office, entered a not guilty plea on Monday to accusations stating she messed with an important witness throughout her son’s case last year involving domestic violence charges.

Karen Cabrera was taken into custody on April 3 under suspicions of planning to deflect the prosecution of her son cause and make sure the case failed to charge him for domestic violence.  Prosecutors claim she  hid the key witness, her son’s girlfriend whom he was accused of attacking, in Mexico in order to keep her from testifying during the trial.

Cabrera, was formerly the supervising investigator who worked on a team that dealt with the death penalty and other high profile cases, and has now been released from jail after posting $30,000 bail.  A preliminary hearing regarding the case is to take place on June 29.

Agency intercepts 69 pounds of cocaine on I-15

Posted by Christina on Mar 03 2009 | Premier Attorneys, San Diego News

Border Patrol officials have caught for the the fourth time this month people attempting to smuggle a large amount of cocaine across the northbound Interstate 15,  Border Patrol spokesman Mark Endicott reported yesterday.

The most recent interception took place on Thursday around 12:30 p.m. when a Border Patrol agent stopped a  Volkswagen Jetta near the patrol checkpoint, a little north of Temecula.

An officer was questioning the driver and could smell a strong scent of air freshener that he assumed was used to cover up the smell of the drugs, which is very common among drug smugglers in order to deceive, said Endicott. The official requested for a canine for investigation.

The dog successfully smelled out the drugs and led police to find the stash hidden within the Jetta. They came upon nine packages of cocaine hidden in the back seat of the vehicle and another 17 packages stored in the back bumper, amounting to a total of 69 pounds, reports Endicott.

Both the cocaine and the unidentified Mexican driver were dealt with by the Drug Enforcement Administration, the spokesman stated.

Over all four incidents, the Border Patrol has accumulated over 275 pounds of cocaine in a matter of 17 days, compared to the 309 pounds the agency seized in three consecutive months prior as a whole, stated Edicott.
